Parents may agree on any parenting time arrangement with the children that they feel is appropriate. One popular misconception is that parents must have equal time with the children under shared parenting. Even with shared parenting, the parents may come up with any parenting time schedule that they feel is appropriate.

Parenting Time

In most circumstances the parent with custody of the children will receive child support from the non custodial parent. In shared parenting situations, generally the higher income earner will pay child support to the lower income earner.

In some cases where there is a disparity in income between the parties, it may be appropriate for the higher income earner to provide some support to the lower income earner for a period of time.

Dissolution is the formal legal proceeding which terminates your marriage after you and your spouse have come to an agreement on all issues, including all parenting issues, support issues and a division of all assets and all liabilities owned by one party or both parties. You and your spouse must come to an agreement on all issues independent of court intervention.

Divorce, the most contentious method of ending your marriage, occurs when spouses cannot agree on how to end their marriage. One spouse must file a complaint for divorce, asking a judge to resolve any unresolved issues relating to the division of assets and liabilities, determination of custody, parenting time arrangements for the children, and the determination of child and spousal support.

All marital assets and debts must be divided. In most cases it is appropriate to equally divide all assets and debts. In some circumstances, valuation of some assets and/or debts may become problematic necessitating special attention.

Division of Property

Custody may be granted to one parent through sole custody or both parents through shared parenting. The fundamental difference between the two is decision making. In a shared parenting arrangement, the parents must make joint decisions on all major issues involving their children.
